English Version – Mining Investments and Update to Tax Procedures

Mendoza, October 2026
Our Ref.: Tax/Mining Paper #6.26 – Mining Investments – Update to Procedures – VAT Recovery – Tax/Administrative Law – Mining Law – National Constitution – Argentine

“K. turned towards the staircase leading to the examining magistrate’s offices, but stopped short, for besides that staircase he could see three other entrances in the courtyard, each with its own staircase, while a narrow passage at the far end of the courtyard appeared to lead into yet another courtyard.”2

Dear Clients and Friends of the Firm,

In Argentina, most administrative procedures seem to follow the architecture imagined by Kafka: one staircase leads to three others, while a passageway, rather than bringing the journey to an end, opens onto yet another courtyard — and one can never be entirely certain where it leads or when the journey will end.

The recent regulatory update to Law No. 24,196 changes the procedures governing the recovery of VAT on exploration activities and imports eligible for tax and customs benefits and appears intended to make taxpayers’ lives — at least a little — easier.

For mining companies, these changes provide an opportunity to review and organise VAT input tax credits for which recovery has already been sought, as well as the supporting documentation for each project, with a view to taking advantage of the new VAT recovery procedures — without, however, mistaking procedural simplification for an expansion of the available exemptions.

Key words: Law No. 24,196 · Mining Investments · Mineral Exploration · VAT Recovery · Input VAT Tax Credits · Integrated Tax Recovery System (SIR) · Imports for Mining Purposes · Customs Benefits · Mining Investment Register · Incentive Regime for Large Investments (RIGI) · Compatibility of Investment Incentives · Kafka.

I. Recovery of VAT on Exploration Activities

ARCA General Resolution No. 5879/2026 incorporates this VAT recovery mechanism into the Integrated Recovery System (Sistema Integral de Recupero – SIR). Resolution No. 66/2026 of the Secretariat of Mining governs the technical review process. The procedure requires coordination between the tax filing and the relevant technical and mining documentation, ensuring consistency between the information submitted through the SIR and TAD platforms.

The twelve-tax-period waiting period established under Section 14 bis of Law No. 24,196 remains applicable. The benefit applies to input VAT tax credits associated with exploration activities that meet the statutory requirements and continue to form part of the taxpayer’s technical VAT credit balance. Digitalisation does not, in itself, render every VAT credit balance held by a mining company eligible for reimbursement.

Aspect Key Control Point
Filing Identify the project, supporting invoices and their connection with the exploration activities.
Technical review Thirty (30) administrative business days, subject to the rules governing observations and the rectification of deficiencies.
Professional support Report issued by an independent certified public accountant in accordance with the applicable regime.
Mining documentation Environmental Impact Declaration and description of the exploration works.

II. Imports for Mining Purposes

Resolution No. 73/2026 of the Argentine Secretariat of Mining (Official Gazette, 1 September 2026) approves the procedure and conditions applicable to the use of the import benefits provided for under Section 21 of Law No. 24,196.

The regime covers new, used and refurbished goods, subject to different requirements in each case; parts, components, spare parts and accessories must be new. Compliance with the exclusive-use requirement and the applicable tariff classifications must also be verified.

III. Customs Implementation and Coordination with the RIGI

ARCA General Resolution No. 5909/2026, published in the Official Gazette on 5 October 2026, incorporates the statutory declaration of use for mining purposes into the Argentine Single Window for Foreign Trade (Ventanilla Única de Comercio Exterior Argentino – VUCEA). Through this system, the statutory declaration of use for mining purposes is transmitted to Customs for validation through the Malvina Information System (Sistema Informático Malvina – SIM).

Section 4 of the Resolution also excludes from the new procedure authorisations for the importation of goods for mining purposes issued prior to its entry into force, provided that such authorisations remain valid when the relevant import declaration is registered in the SIM. Accordingly, before formally registering each import, we recommend determining whether an existing and valid prior authorisation may be used or whether a statutory declaration must be filed under the new procedure.

Coordination with the RIGI, on the other hand, is governed by Section 4 of Annex I to Resolution No. 73/2026. Where the beneficiary is also covered by that regime, it must declare that the goods in respect of which it seeks the exemption under Law No. 24,196 are not covered by the customs incentives available under the RIGI. The coexistence of these regimes therefore requires compatibility to be assessed on a good-by-good and transaction-by-transaction basis.

VI. Our Firm’s Recommendations

We recommend reconciling tax credit balances and supporting invoices against the works actually carried out; identifying expenditure on a project-by-project basis; verifying that all environmental and registration documentation remains valid and up to date; and preparing the independent accountant’s report in advance.

For imports, it is advisable to review the applicable tariff classification, the condition of the equipment, its intended use and the specific incentive regime under which the relevant benefit will be claimed.

The modernisation of these procedures may improve the working capital available for future exploration programmes. The extent to which companies can take advantage of these improvements will depend on the quality and consistency of their filings and on effective coordination between each company’s legal, accounting, technical and customs teams.
